1. Scope
These Terms and Conditions apply to all contracts concluded between Pullman City Westernstadt GmbH & Co. KG in Ruberting 30, 94535 Eging am See, and its guests, as well as to entry into the grounds of the Pullman City Wild West Town.
As a Wild West theme park, Pullman City offers the opportunity for day trips, overnight stays, experience-focused restaurants, events, and the purchase of goods, vouchers and tickets.
2. Conclusion of contract
PC Westernstadt GmbH & Co. KG will send the customer an offer to conclude a contract upon receiving their booking request. The contract is concluded when the last page of the offer is sent, signed, to PC Westernstadt GmbH & Co. KG.
3. Over-occupancy, subletting
The maximum occupancy of the accommodation units is the number of persons specified in the description of the building for the accommodation in question that has been booked. Children are considered a full person (exception: in the hotel rooms, additional persons can be accommodated on extra beds/a sofa bed for an extra charge). The subletting of the accommodation unit provided as well as its over-occupancy require the prior written consent of PC Westernstadt GmbH & Co. KG. In the event of over-occupancy, there is usually no sleeping accommodation or other residential equipment available for all surplus persons. If PC Westernstadt GmbH & Co. KG has given its consent to the over-occupancy, it is entitled to demand an additional charge for these extra persons. If PC Westernstadt GmbH & Co. KG has not given its written consent, it is entitled to turn away/eject the extra persons.
4. Arrival and departure, prices, deposit
a) PC Westernstadt GmbH & Co. KG will keep the booked accommodation unit available for the guest until 5 p.m. on the day of arrival and will provide the agreed services.
If guests will be arriving after 5 p.m., PC Westernstadt GmbH & Co. KG must be informed of this, otherwise PC Westernstadt GmbH & Co. KG is entitled to rent out the accommodation to others, without the guest having any possibility of deriving a claim as a result.
b) Log cabins, tipis and hotel rooms will be available for the guest on the day of arrival from 2.00 p.m.
c) For log cabins and tipis, a deposit of €100.00 per accommodation unit is to be paid in cash at the reception upon arrival. A deposit of €20.00 is to be paid for each hotel room.
The deposit will be retained in the event of any of the following:
- Check out later than 10.00 a.m.
- Loss of deposit receipt and/or key
- Bringing alcohol from elsewhere onto the premises
- Vandalism or violation of public morals.
d) The guest is obliged to pay the applicable/agreed prices to PC Westernstadt GmbH & Co. KG for the provision of the accommodation unit and the other services availed of. This also applies to payments and outlays to third parties instigated by the guest.
e) PC Westernstadt GmbH & Co. KG is entitled to demand an advance payment. If the guest does not make the advance payment within a period set by PC Westernstadt GmbH & Co. KG, PC Westernstadt GmbH & Co. KG is entitled to withdraw from the contract.
PC Westernstadt GmbH & Co. KG is also entitled to extraordinarily withdraw from the contract for an objectively justified cause, in the event that, for example:
- force majeure or other circumstances exist for which PC Westernstadt GmbH & Co. KG is not responsible that make the fulfilment of the contract impossible;
- accommodation units are rented on the basis of misleading or false information relating to essential facts, e.g., the guest's person or the purpose of the rental; or
- PC Westernstadt GmbH & Co. KG has reasonable grounds to believe that the use of the accommodation unit may jeopardise the smooth operation, security or public reputation of PC Westernstadt GmbH & Co. KG, and this is not attributable to the domain or organisational scope of PC Westernstadt GmbH & Co. KG.
If PC Westernstadt GmbH & Co. KG exercises its right of withdrawal, the guest shall not be entitled to compensation, except in the event of intentional or grossly negligent behaviour on the part of PC Westernstadt GmbH & Co. KG.
f) The scope of services does not include travel cancellation or liability insurance. It is advisable to take out these insurance policies.
g) Our Wild West Town is constantly growing for you, so as to offer you an unforgettable visit and experience at all times. Therefore, we ask for your understanding when works are ongoing within the park. Of course, we try to reduce construction site activity to a minimum during your visit. However, the confirmed trip price remains valid without modification, and we cannot accept any claims for damages.
5. Pets
Guests are allowed to bring pets with them. This does not apply to hotel rooms and suites. The pets must be registered at reception upon arrival, at the latest. The accommodation of pets is subject to a surcharge per the price list.
6. Withdrawal, cancellation fees
The guest can withdraw from the contract at any time by declaring this in writing. The time at which the written declaration of withdrawal is received by PC Westernstadt GmbH & Co. KG shall be decisive. Cancellation fees then apply according to the following tiers:
up to 45 days before arrival 10% of the rental price
up to 30 days before arrival 30% of the rental price
up to 22 days before arrival 60% of the rental price
up to 9 days before arrival 80% of the rental price
8 days or fewer before arrival or in the event of a no-show 100% of the rental price
7. Site and property brochures
Site and property leaflets and brochures are only informational purposes only, and no guarantee is provided with respect to their content. Local conditions that do not affect the holiday property do not form part of the subject of this contract.
8. Alcohol
Bringing alcoholic beverages onto the premises is strictly prohibited. Checks are carried out by our staff. In the event of contraventions, the deposit will be retained and the drinks will be confiscated. You will receive the drinks back when you leave our premises.
9. Dress code
Entering the grounds of PC Westernstadt with inappropriate clothing, such as carnival, convict or Native American costumes, is prohibited. PC Westernstadt reserves the right to refuse admission in the event of non-compliance with this dress code. Any refund of payments is excluded in these cases.
10. Urination
Plenty of sanitary facilities, with toilets and hand washing facilities, are available on the grounds of the Pullman City Wild West Town. Urinating in public on the grounds of the Pullman City Wild West Town outside of the designated toilets is not permitted and will be punished with retention of the deposit and immediate eviction from the premises.
11. Electrical devices
Bringing, connecting and using your own electronic devices, such as microwaves, hobs, generator sets, refrigerators, coffee machines, sound systems, and the like, is strictly prohibited.
12. Transporting luggage
For transporting luggage, only the hand transport trolleys offered by Pullman City or similar hand transport trolleys belonging to the guest may be used. The use of means of transport other than those mentioned is strictly prohibited. Pullman City does not offer luggage transport by tractor, or the like!
13. The situation with regard to the coronavirus
All measures relating to the coronavirus must be observed. These can be found in the form of notices and markings throughout the grounds. The instructions of staff are to be followed. Those who resist such instructions will be punished with retention of the deposit and immediate eviction from the premises.
14. PAYMENTS
All payments are made via bank transfer, in cash, or via payment interfaces.
15. Place of jurisdiction
The place of jurisdiction is Passau.
16. Invalidity
The invalidity of any individual clauses shall not affect the validity of the remainder of the contract.
